The Construction (Health, Safety and Welfare) Regulations came into force in September 1996 and superseded the earlier provisions and regulations.
In compiling the Regulations, the Government took the opportunity to implement recommendations made by the Scrutiny Review relating to Fire Safety on construction sites, which highlighted the complexity and evolving nature of construction activities which presented special risks to Builders and Contractors directly involved in activities and, in the case of work in existing buildings, to any occupants and other relevant persons who use or resort to the premises whilst construction is taking place.
Therefore, by virtue of the Regulations The Fire Authority are responsible for the General Fire Precautions on Construction Sites forming part of an occupied premises whilst construction work takes place.
The Health and Safety Executive retain their present responsibility for Process Fire Precautions on those sites and for all aspects of Fire Safety on unoccupied or secured construction sites.
Regulation 4 of the Construction (Health, Safety and Welfare) Regulations 1996 imposes specific duties on Employers, Self Employed, all persons who control construction work, Employees and any persons who carry out, control the way, construction work is carried out.
The Regulations place general duties on Employers and the Self Employed to make effective arrangements for Managing Health and Safety.
The Order imposes general duties to ensure, so far as is reasonably practical, the safety of Employees, a general duty, in relation to non-employees to take such Fire Precautions as may reasonably be required in the circumstances, to ensure that premises are safe.
